For the Petitioners Though the petitioners initially sought quashing of proceeding being G.R. case no. 441/2007 pending before the learned Additional Chief Judicial Magistrate, Haldia, Purba Medinipur, learned counsel for the petitioners submits that the petitioners do not intend to proceed with the said prayer. The petitioners have assailed the order dated 6th November, 2024 passed by the learned Magistrate directing issuance of warrant of arrest against them.

Learned counsel for the petitioners submits that the petitioners were granted anticipatory bail by virtue of which they surrendered before the learned Additional Chief Judicial Magistrate, Haldia and were granted bail. The petitioners appeared before the learned Magistrate all throughout. They failed to appear before the learned Magistrate on 6th November, 2024 and filed an application seeking adjournment which was turned down and warrant of arrest issued against them. The petitioners undertake to surrender before the learned Additional Chief Judicial Magistrate, Haldia within 10 days from date. If the petitioners surrender before the learned Additional Chief Judicial Magistrate, Haldia within 10 days from date and pray for bail, learned Magistrate shall deal with the application in accordance with law. In the event the petitioners fail to surrender before the learned Magistrate within the stipulated time frame, the learned Magistrate shall be at liberty to take steps against the

petitioners, in accordance with law without further reference to this Court.

Warrant of arrest issued vide order dated 6th November, 2024 be stayed qua the petitioners till 10th March, 2025. CRR 5187 of 2024 is disposed of.
