Learned advocate representing the private respondent submits, upon instruction that, two plots are involved in the instant writ petition.

Plot no. 3016 is recorded as 'Bastu' and construction is permitted thereon. Plot no. 3017 is not a water body though the same is recorded as 'Pukur'. The private respondent contends that construction has been made over both the plots of land.

Learned advocate representing the municipality submits that there are deviations in each and every floor of the G+3 storied building. The Municipality is taking steps to deal with such unauthorised construction. The

Municipality has already issued a stop work notice and no construction is continuing at present.

In view of the above, the matter is disposed of by directing the Municipality to take steps to deal with any unauthorised construction at the aforesaid plots in accordance with law after giving reasonable opportunity of hearing to all the necessary parties.

A reasoned order shall be passed and communicated to the parties.

Effort shall be taken to conclude the proceeding at the earliest but positively within twelve weeks from the date of communication of this order.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
