It is submitted on behalf of both the parties that the dispute between the parties was referred to Calcutta High Court Mediation Centre and the dispute has been settled by way of mediation and to that extent final report has also been submitted which is annexed at page 13 of the application. It further appears that in terms of amicable settlement arrived at due to said mediation the parties have decided not to proceed with the present application being CRR 3930 of 2015 where the petitioner has prayed for quashing of the Miscellaneous Case No. 14 of 2011 corresponding to T.R.Case No. 88 of 2011 where the court below while passing the judgment directed the petitioner to

pay maintenance under section 125 of the Code of Criminal Procedure @ Rs. 25,000/- per month from the date of passing of the order.

Mr. Roy, learned counsel appearing on behalf of the opposite party on instruction submits that his client does not want to proceed with the present application and his client has got no objection if the judgment passed in Miscellaneous Case No. 14 of 2011 corresponding to T.R.Case No. 88 of 2011 passed by learned 2nd Judicial Magistrate at Alipore, 24 Parganas, is quashed in terms of the amicable settlement arrived at.

In such view of the matter, and also in view of amicable settlement in terms of the mediators report, the judgment passed by 2nd Judicial Magistrate at Alipore in Miscellaneous Case No. 14 of 2011 corresponding to T.R. Case No. 88 of 2011 dated 3rd October, 2015 is hereby quashed.

CRR 3930 of 2015 is disposed of accordingly interms of amicable settlement.

In view of disposal of the main application, connected applications are accordingly disposed of.

Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance of usual undertakings.
