Petitioner complains that police authorities were inert to the information which was furnished. The main grievance of the petitioner is that the private respondents are trying to dispossess the petitioners from enjoying their property and also interfering with their peaceful possession.

Inspite of repeatedly informing the police authorities, no steps have been taken.

Learned advocate for the private respondents, on the other hand, contends that there were earlier litigations which have been instituted. One at the instance of the respondents before the

ACJM Uluberia being Complaint Case No. 319 (c) /21 another case being Bagnan PS Case No. 320/22 dated 19.06.2022.

Attention has been drawn to an earlier order passed in W.P. 17752(W) of 2009.

State has submitted a report. Report reflects that the police authorities on receipt of the information submitted by the petitioner has drawn up proceedings being Bagnan PS Case No. 678/24 dated 10.12.2024 under the relevant provisions of BNS against the respondent nos. 5 and 6 and the investigation of the case is in progress.

Having considered that the petitioners and the private respondents are at loggerheads, I direct the concerned Officer-in-Charge to keep a strict vigil and to ensure that no breach of the peace and/or tranquility takes place. It would be the duty of the concerned Officer-in-Charge to also check any untoward incident which may result because of the inimical relationship existing between the petitioners and the private respondents.

With the aforesaid observations WPA 29201 of 2024 is disposed of.
