The husband of the petitioner was a librarian in Ramnagar College, Purba Medinipur. He died in harness on 20th October, 2006. Though other terminal benefits including family pension were provided to the petitioner after the death of her husband, later, it was discovered that nothing has been paid to the petitioner on account of leave encashment. The relevant college, however, found that the petitioner was entitled to a sum of Rs.1,81,160/- on account of leave encashment and accordingly, by a communication dated 9th September, 2016 it requested the Director of Public Instructions, West Bengal to disburse the said amount.

Learned advocate appearing for the petitioner submits that thereafter the petitioner also went on making various representations before the Director of

Public Instructions, West Bengal but till date no payment has been made to the petitioner.

In view of above factual backdrop, I dispose of this writ petition with a direction upon the Director of Public Instructions, West Bengal to consider the representation dated 30th October, 2023 made by the petitioner in accordance with law. If it is found that the petitioner is entitled to the leave encashment amount, the same shall be provided to the petitioner within two months from the date of communication of this order. The Director of Public Instructions, West Bengal will be at liberty to hear the petitioner as well as the College in arriving at the decision.

With the aforesaid observations, WPA 27976 of 2023 is disposed of.
