1. By this public interest litigation, the petitioner seeks for an investigation by a Central agency on the ground that the representation given by the petitioner to the Secretary, Department of Animal Resources Development, Government of West Bengal dated 28th July, 2023 has not been considered.

2. The sum and substance of the representation is that there has been large scale defalcation of public money and there is an allegation that the officers of the State Government have siphoned off funds, which have been allotted under various schemes and the actual beneficiaries have not been paid any amount under the various schemes. Since the representation given to the Secretary, Department of Animal Resources Development has not been considered till date, at this juncture, we do not express any opinion as to whether a Central agency has to investigate the matter. However, there is a duty casts upon the department of Animal Resources

Development to give a proper reply to the representation dated 28th July, 2023 given by the petitioner.

3. Prima facie, we are of the view that the writ petitioner has given several details in the representation and the representation appears to be a comprehensive representation.

4. In the light of the above, the writ petition stands disposed of by directing the Secretary, Department of Animal Resources Development, Government of West Bengal, respondent no.3 to consider the representation dated 28th July, 2023 and pass a speaking order and communicate the same to the petitioner within a period of three weeks from the date of receipt of server copy of this order.

5. In order to facilitate compliance of this direction within the time frame, the petitioner is directed to forward one more copy of the representation along with the copy of this order to the respondent no.3 for effective and prompt compliance.

6. No Costs.

7. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
