Suman Ghosh, learned senior government advocate is directed to represent the state with a junior of his choice. His appointment may be regularized by the concerned authorities.

I have considered the contentions advanced in the writ petition. The same is, prima facie, on the ground that the petitioner has been thrown out of her matrimonial home and is without shelter.

So far as other accusations are concerned, it reflects that Dantan PS Case No. 245 of 2019 was registered for investigation under section 498A/323/313/34 of the Indian Penal Code and section 3 & 4 of the Dowry Prohibition Act. The police authorities have taken steps so far as demand of dowry and other physical and mental torture is concerned.

Since the grievance of the petitioner presently is in respect of a shelter, petitioner would be at liberty to invoke the jurisdiction of the learned Magistrate under the provisions of PWDV Act for residential accommodation either in the shared household or a rented accommodation, the reliefs which may be granted under the said act.

With the aforesaid observations WPA 30069 of 2024 is disposed of.
