Mr. Sudhakar Biswas, learned counsel appears for the petitioners.

Mr. Malay Singh, learned Counsel appears for the State-respondents. He places a written instruction dated December 23, 2024 issued under the signature of the Inspector General of Police & State Commandant, W.B.N.V.F. Directorate, Kalyani, Nadia, the same is taken on record.

The petitioners retired as NVF personnels. The petitioners have received ex-gratia for a sum of Rs.50,000/- and now claim interest on the delayed payment of the ex-gratia.

Following the decision of the Hon'ble Division Bench dated January 18, 2023, In the matter of: The

State of West Bengal & Ors. -vs- Habibur Rahaman Halder & Ors. rendered in MAT 2093 of 2022 with CAN 1 of 2023, the respondent no.2 and/or any other appropriate authority shall pay interest at the rate of 8% per annum since the next date of retirement of the petitioners till the date of actual payment made to the petitioners. The payment shall be made positively within a period of six weeks from the date of communication of this order.

In addition, the respondents shall pay cost to each of the petitioners a sum of Rs.5000/- as directed by the Hon'ble Division Bench.

This order shall be effected upon payment of the deficit Court Fees. One Court Fee has been paid. Balance eleven has to be paid and only then this order will be effected.

On the above terms, this writ petition, WPA 29263 of 2024 stands disposed of.
