1. Affidavit of service filed in Court today is taken on record.

2. The petitioner is aggrieved by the order passed by the Divisional Commercial Manager, Eastern Railway, Sealdah dated 23rd October, 2024. It appears that the dispute arises out of a contract entered in between the parties.

3. The petitioner is aggrieved by the termination of contract and seeks compensation.

4. I am of the opinion that, the issue ought not to be decided by the writ Court. There are question of facts which are to be adjudicated for providing adequate relief to the petitioner. The same cannot be done in a writ proceeding.

5. In view of the above, the instant writ petition stands disposed of by observing that, it will be open for the petitioner to approach the competent Civil Court for redressal of his grievances, if so advised.

6. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
