The State of West Bengal and Ors.
Mr. Sabyasachi Chatterjee.
Mr. Badrul Karim.
Ms. Kiron Sk.
Mr. Sarajit Roy.
... For the petitioner.
Mr. Jahar Lal De.
Md. Ziaur Rahaman.
... For the State.
Mr. A. Ghosal.
Ms. D. Mitra.
Mr. S. Ghosh.
... For the respondent nos. 10 and 11.
Petitioner is aggrieved by the fact that in spite of allegations made against some of the officers of the administration, no action has been taken in the FIR which has been registered being Santiniketan PS Case No. 84 of 2024.
Learned advocate also submits that pursuant to the FIR by way of counter blast, a case has been registered at the behest of the accused persons also.
It has been submitted that there has been threats, which have been made to the petitioner who happens to be a member of the Scheduled Caste community. Learned advocate for the State has submitted a report. The report reflects that another case has been instituted being Santiniketan P.S. Case No. 174 of 2023 dated 14.11.2023 at the behest of the present petitioner. The report also reflects that final report has been submitted in the case which has been registered both in cases of Santiniketan P.S. Case No. 84 of 2024 and Santiniketan P.S. Case No. 174 of 2023.
Learned advocate for the private respondent nos.
10 and 11 submits that the respondents have been foisted with number of criminal cases at the instance of the petitioner as the petitioner is intending to grab the property of the respondents.
Be that as it may, so far as the remedy in respect of criminal cases are concerned, petitioner would be at liberty to approach the jurisdictional Court if the petitioner intends to pursue for further investigation into the case.
So far as other accusations are concerned, I find that at present the petitioner and the private respondents are at loggers head.
Accordingly, the police authorities will keep strict vigil and ensure that no breach of peace and tranquility will take place and no untoward incidents results because of the inimical relationship existing between the parties.
As the State and the private respondents have not been called on to use any affidavit, the accusations made against the State as well as the private respondents are deemed not to have been admitted.
With the above observations, WPA 29299 of 2024 is disposed of.
Report so submitted be kept with the records. There shall be no order as to costs.
