The report dated 07.10.2021 submitted by Officer-inCharge, Bowbazar Police Station be kept with the record. The Officer-in-Charge, Bowbazar Police Station is present in Court. His further appearance before this Court is dispensed with.

During the pendency of this revisional application, a joint compromise petition was taken out by the petitioner who was implicated as an accused in this case and the complainant who was authorised representative of Moneywise Financial Services Pvt. Ltd.

Pursuant to the joint compromise petition being filed, a report was called for from the Officer-in-Charge, Bowbazar

Police Station. The said report dated 07.10.2021 reflects that the complainant viz. Moneywise Financial Services Pvt. Ltd. is not inclined to proceed further with Bowbazar Police Station Case No. 159 of 2013 dated 25.03.2013 under Sections 406/420/120B of the Indian Penal Code.

Having regard to the nature of the transactions which are referred to in the case records, I am of the view that the dispute is private and personal in nature. As such, further continuance of the proceeding is unwarranted. Accordingly, all further proceedings arising out of Bowbazar Police Station Case No. 159 of 2013 dated 25.03.2013 (G.R.No. 1185 of 2013) under Sections 406/420/120B of the Indian Penal Code then pending before the learned Chief Metropolitan Magistrate, Calcutta are hereby quashed.

The prayer advanced in application being CRAN 1 of 2021 along with CRR 3291 of 2013 is, thus, allowed. Pending other application, if any, is consequently disposed of.
