Pursuant to the complaint lodged by the petitioner in respect of her apprehension that her child may be taken away she informed the police station but no action was taken.

Police report has been submitted by the Inspector in Charge, Harishchandrapur Police Station which reflects that on 9th December, 2024, the brother of the petitioner lodged a complaint which was registered as Harishchandrapur Police Station Case No. 1062 of 2024 dated 09.12.2024.

Petitioner complains that so far as the property is concerned, the court must give direction for custody of such property.

In view of the fact that the issues relating to the property are within the exclusive domain of the civil Court, this Court will not interfere with such prayers. However, the petitioner would be at liberty to invoke the powers of the jurisdictional Court so far as the issues relating to the property is concerned. As the petitioner also apprehends that she may be harassed, heckled and her property may be taken away, I direct that the police authority would ensure that no untoward incident happens because of the inimical relationship existing between the petitioner and the private respondents.

Since police case has already been registered at Harishchandrapur Police Station, the investigation of the same be taken to its logical conclusion. If any witness is threatened, the police authority would analyse the threat perception and accordingly render their assistance.

With the aforesaid observation, WPA 29294 of 2024 is disposed of.

Report so submitted be kept with the record. Copy of the report has been handed over to the learned advocate for the petitioner.

Urgent photostat certified copies of this order, if applied for, be issued to the parties on compliance of requisite formalities.
