Babita Khatun v. State Of West Bengal And ORS.
29.08.2023 Item No.17 Court No.18 AJ.
W.P.A. 29035 of 2022 Babita Khatun -Vs- The State of West Bengal & Ors.
Mr. Sabyasachi Hazra.
.....for the petitioner.
Dr. Sutanu Kumar Patra, Ms. Supriya Dubey.
.....for the WBCSSC.
Mr. R.K. Biswas, Mr. Santanu Mondal.
...for the respondent nos.5 & 6.
The petitioner is an Assistant Teacher in subject History at Ahio Girls' High School (H.S.), District : Malda, she has applied for general transfer under Utsashree Portal.
The grievance of the petitioner is that her application has failed to attract the attention of the concerned authorities till date.
Mr. Biswas, learned Advocate for the School Authorities, the respondent nos. 5 and 6 herein submits that the school has student strength of more than 1100 and the petitioner is only subject teacher of the school, moreover, she has applied for general transfer within three years from the date of her appointment, which is contrary to the Rule.
The school has a good student strength but is already suffering from dearth of teachers, as such, the application of the petitioner for
general transfer does not deserve any consideration, particularly when such application has been made within the gestation period prescribed under the Rule, that apart, the operation of the relevant Portal is now under suspension.
W.P.A. 29035 of 2022, for the aforesaid reason, is dismissed without any order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
