None appears on behalf of either of the parties. No accommodation is sought for.

Furthermore, despite direction no affidavit in opposition and affidavit in reply have been filed by the parties as per office report.

This is a case pending since 2007.

Considering the long pendency of this writ petition, this Court prefers to decide the instant case on merits on the basis of nature of prayer and documents available in the record.

This instant writ petition has been filed by the petitioner seeking direction upon the respondent authorities to advertise the vacant post of Peon under Group-'D' category to be filled up at Uttar Rupamari High School (Higher Secondary) of village Uttar Rupamari, Post Office- Rupamari, Police StationHasnabad, DistrictNorth 24-Parganas in the Newspaper, Radio, Television forthwith.

At the time of admission of this writ application, a direction was passed by the learned Co-ordinate Bench that no further step shall be taken in the matter

towards filling up of the post in question without appropriate advertisement inviting applications for the post until further order. A direction was also passed to file affidavits by the parties. Thereafter, this matter has been listed before this Court after a long gap. 7.

In the above backdrop and considering the case and prayer of the petitioner, this Court does not find any merit after long passage of time; almost 18 years have passed. Such prayer cannot be allowed at this stage.

Furthermore, it manifestly appears that the petitioner has lost his interest due to passage of long period.

In view of the above facts and circumstances, this writ petition has no merit and the same is hereby dismissed.

Interim order, if any, stands vacated.

11.

There shall be no order as to costs.

Parties to act upon the server copy and urgent photostat certified copy of this order be given on usual terms and conditions.
