The petitioner applied for transfer both on the ground of distance and the medical condition of his wife.

2.

The DPSC, Malda shall ascertain the medical condition of the petitioner's wife from the CMOH, Malda and forward the report thereto with comments to the Secretary, West Bengal Board of Primary Education.

Upon receipt of such report, the West Bengal Board of Primary Education shall pass appropriate orders strictly in accordance with the rules within a period of 10 weeks from date.

Let a copy of the writ petition and a copy of this order be served on the DPSC, Malda and the West Bengal Board of Primary Education for information.

5.

With the aforesaid directions, the writ petition is disposed of.

6.

There shall be no order as to costs.

7.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
