Affidavit of service filed in Court today is taken on record.

None appears on behalf of the private respondent.

The petitioner alleges illegal and unauthorized encroachment over public road.

4.

An objection by the petitioner is pending consideration at the end of the Assistant Engineer, P.W. (Roads) Directorate.

Learned advocate appearing on behalf of the State respondents submits that the petitioner herself is an encroacher of government land.

According to the petitioner, the said encroachment has been removed.

Be that as it may, as an objection alleging encroachment of public road is pending consideration at the end of the Assistant Engineer, accordingly, the instant writ petition is disposed of by directing the respondent no. 4, the Assistant Engineer, P.W. (Road),

Directorate, Kakdwip to take into consideration the objection of the petitioner in accordance with law after giving a reasonable opportunity of hearing to all the necessary parties and dispose of the same by passing a reasoned order at the earliest but positively within a period of twelve weeks from the date of communication of this order.

Learned advocate appearing for the petitioner is directed to forward a copy of the objection to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
