Let the supplementary affidavit filed by the writ petitioner be kept with the record.

Let a copy of the report be handed over to the petitioner as well as private respondents.

The petitioner is aggrieved by the fact that during pendency of the civil suit as well as criminal case, again an incident happened on 9th December, 2024 when the CCTV was broken along with the western side of the wall being damaged.

To that effect, the police authorities have already registered a case being Domjur Police Station Case No.999 of 2024 dated 13.12.2024.

The report submitted by the State reflects that there are civil cases as well as criminal cases pending between the parties. Investigation is going on in respect of the accusations, which have been made. Both the civil cases are before the learned Civil Judge (Junior Division), Fourth Court, Howrah. It is reflected from the report that next date has been fixed on 9th January, 2025 for hearing of the application under Section 151 of the Code of Civil Procedure. Till the hearing is concluded and specific order is passed in the said application by the learned Civil Judge (Junior Division), Fourth Court, Howrah in Title Suit No.232 of 2024, the police authority will keep a strict vigil so that no damage is caused to property or person in respect of either of the parties (petitioners and private respondents).

In view of the present inimical relationship between the parties a strict vigil be maintained by the police authorities. In case, the Civil Court passes specific directions, the police authority would respect, obey and be bound by the said order concerned. With the aforesaid observations, WPA 29113 of 2024 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
