For the Petitioner Report submitted by the learned Registrar (Judicial Service), High Court, Calcutta is taken on record. Learned counsel for the petitioner submits that the Criminal Appeal being no. 59 of 2022 filed by the opposite party before the learned Additional District Judge, 9th Court, Alipore is pending since the Court is lying vacant. The interim monetary relief payable to the petitioner has been reduced to Rs.13,000/- per month from Rs.18,000/- per month by the learned appellate Court by an order passed on 16th June, 2022. Huge arrear is also due.
The petitioner seeks to withdraw the application and file an appropriate application before the learned District Judge, South 24 Parganas at Alipore seeking transfer of the Criminal Appeal to any other Court since the Court of the learned Additional District Judge, 9th Court, Alipore is still lying vacant. In the event the petitioner files such application before the learned District Judge within a fortnight from date, learned District Judge shall dispose of the same as expeditiously as possible, preferably within one month from the date of filing of the application.
CRR 5228 of 2024 is dismissed as withdrawn.
