Mr. Sounak Bhattacharya, Mr. Sounak Mandal ...for the Petitioner Mr. Victor Chatterjee ...for Visva Bharati 29-04-2024 AKG Ct. 238 The petitioner along with 8 (eight) other candidates were selected for Ph.D. (Education) programme at Visva Bharati for the academic year 2022-2023. Admittedly, nine areas of specialisation were available to the nine selected candidates.

The petitioner opted for the subject namely, "Teacher Education."

The university submits that the said subject has already been allotted to a selected candidate belonging to the „General‟ category.

The petitioner belongs to "Scheduled Tribe" category. It is not in dispute that the subject "Instructional Technology" has not yet been allotted to any of the selected candidates.

The petitioner is willing to do her Ph.D. in the said subject.

I do not see any reason not to grant the prayer when the said subject has not yet been allotted to any of the selected candidates.

Accordingly, this writ petition is allowed with a direction upon the university to enroll the petitioner for

the Ph.D. programme in "Instructional Technology" commencing from the academic year 2022-2023.

WPA 28062 of 2023 is allowed.

Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
