Report submitted by the learned advocate appearing for the State be kept with the record. The writ petition was preferred in spite of the learned ACJM, Alipore being approached under Section 175(3) of BNSS. At the relevant date on 20.12.2024 it reflected that the learned Magistrate kept 30.12.2024 as the next date for passing order. Earlier on 24.01.2025, an accommodation was sought for on behalf of the petitioner.

Today when the writ petition has been called, none represents the petitioner.

No accommodation is sought for on behalf of petitioner.

State has submitted a report dated 22.08.2025. Record reflects that the application under Section 175(3) of BNSS is still pending and on each occasion, the petitioner did not appear before the learned court.

Having considered that an application under Section 175(3) of BNSS is pending, I am not inclined to interfere with the prayers advanced in the writ petition.

Accordingly, the writ petitioner being WPA 29370 of 2024 is dismissed.

Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
