WPA 28791 of 2025 (Tuhin Mondal vs. State of West Bengal & Ors.) Mr. Debapriya Majumder .... For the Petitioner Mr. Rajat Dutta Ms. Ratna Das .... For the State Affidavit of service filed by the petitioner and the report submitted by the State are taken on record. The petitioner is aggrieved by the fact that the police authority has not registered his complaint as FIR. There is a civil suit pending between the petitioner and his relatives who are co-sharers of ancestral property, a portion of which has been gifted to the petitioner by his grandfather. The civil dispute between the parties shall be dealt with by the appropriate civil forum. It appears that after the writ petition was filed a notice has been issued to the petitioner requesting him to appear before the police station for the purpose of investigation.

The petitioner shall co operate in investigation. Necessary steps be taken by the police authority in terms of the complaint lodged by the petitioner. The investigation should be conducted in a fair, unbiased and impartial manner and taken to its logical conclusion in accordance with law.

In the meantime, the police authority shall keep strict vigil over the area in order to avoid any untoward incident in view of the strained relationship between the parties and shall also ensure maintenance of peace and tranquility. The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
