Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the owner of the premises in question. He purchased a property in 2001 and applied for a new electricity connection. He obtained it. The tenant there was continuing with the existing electricity connection in the name of the erstwhile owner. But, that cannot be done. Therefore, the petitioner prays for disconnection of the electricity given to the tenant.

Learned counsel appearing on behalf of the CESC Limited denies the allegations made in the writ petition and submits as follows. As would be evident from the relevant

documents relied upon, the meter has already been changed in the name of the tenant from the name of the erstwhile owner. Even the mistake in recording of address has been corrected.

It appears that the respondent authorities have quite lawfully altered the name of the erstwhile owner in respect of the meter to the name of the tenant in question. Therefore, there is no merit in the writ petition. Accordingly, the same is dismissed, however, without any order as to costs.

As affidavits were not called for, the allegations contained in the writ petition are deemed not to have been admitted.
