Petitioner complains that Narayangarh P.S.

Case No.87 of 2024 was registered for investigation under the relevant provisions of the Indian Penal Code as well as Scheduled Caste and Scheduled Tribe. (Prevention of Atrocities), Act, 1989, wherein subsequent to the accused persons being released on bail on or about 13th August, 2024, the accused persons have been threatening the petitioner and her family members with dire consequences.

Learned advocate appearing for the State has submitted a report.

Report reflects that the investigation of the case has been concluded and

charge-sheet has been submitted before the learned special court against four accused persons.

As the petitioner is aggrieved by the fact that in spite of she and her family members being threatened, no steps have been taken by the administration or the police authorities, I direct that the petitioner would be at liberty to inform the learned jurisdictional special court. Learned special court would on consideration of Section 15A of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 take steps and pass necessary directions upon the appropriate authorities for ensuring regarding the threat perception and for protection of the present petitioner and her family members. Learned special court would also ensure that on each and every date the de facto complainant or her representative be present in accordance with the provisions of the Special Act referred to above. With the aforesaid observations, WPA 29384 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
