02.02.2026 Court No.28 Item No.13 ssi CRM (A) 4323 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Tamluk Police Station Case No. 762 of 2025 dated 24.09.2025 under Sections 85/115 (2)/ 117(2)/ 109/3(5) of the BNS 2023 AND Sections 3 and 4 of the DP Act.

Anwar Hossain Mr. Rajesh Jana ..for the State Learned counsel appearing on behalf of the petitioner submits that within five months of marriage, the alleged victim left the matrimonial home of her own volition. The FIR was lodged about 45 days after the alleged date of leaving.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the statements of the witnesses including that of a neighbor present at Page 13 of the case diary. He also refers to the medical report present at page 22 of the case diary.

Considering the above and the other incriminating materials available in the case diary and the fact that the petitioner is the principal accused in this case, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.

The presence of the Investigating Officer is noted and is dispensed with.
