13.02.2026 Court No.28 Item No.21 tbsr CRM (A) 4326 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Duttapukur P.S. Case No.711 of 2025 dated 25.09.2025 under Sections 329(4)/117(2)/79/3(5) of the BNS and under Sections 8/12 of Protection of Children from Sexual Offences Act, 2012. And In the matter of: Ibrahim Ali @ Ibrahim Molla ....Petitioner.

Md. Shahjahan Hossain Ms. Sanjida Sultana Mr. Prithwiraj Bisws Mr. Souvik Shaw ...for the petitioner.

Mr. B. K. Roy Ms. Puspita Saha .....for the State.

Ms. Tannistha Bandyopadhyay ....for the de facto complainant.

Heard the learned counsels for the petitioner, the de facto complainant and the State.

Learned counsel appearing on behalf of the State relies on the charge sheet present in the case diary and submits that the charge sheet no. 955 dated 12.12.2025 has been submitted only against the principal accused, Taleb Molla. Although it has been stated in the charge sheet that a supplementary charge sheet may be filed if there is any further development of investigation, it is obvious that charge sheet has not been submitted against the present petitioner. Therefore, it cannot be said that the petitioner still has any apprehension of arrest.

Accordingly, the application for anticipatory bail is disposed of, without any further order, even as to costs.

However, if the petitioner is subsequently made an accused in this case, he shall be at liberty to pray for anticipatory bail. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
