21.01.2026 Court No.28 Item No.56 ssi CRM (A) 4328 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with English Bazar Police Station Case No. 938 of 2019 dated 15.09.2019 under Sections 302/34 of the Indian Penal Code and adding Section 306 of the Indian Penal Code.

Mijanur Rahaman ...for the petitioners Mr. Rudradipta Nandy, Ld. APP Mr. Sachit Talukdar ..for the State Learned counsel appearing on behalf of the petitioners submits that in 2019, the petitioner was granted anticipatory bail. Thereafter, he surrendered before the learned jurisdictional Court and was granted bail. He attended Court for a long time. Because of his absence on few occasions, a warrant of arrest has been issued. Learned counsel for the State submits that the second application for anticipatory bail is not maintainable. The petitioner had taken benefit of an order of anticipatory bail, surrendered and obtained bail. Thereafter, he jumped bail. He even prayed for setting aside of the warrant of arrest. The same was set aside. Yet, he did not surrender. It appears that the petitioner was granted anticipatory bail and thereafter obtained bail. Then he jumped bail and warrant was issued.
In view of the above, a further application for anticipatory bail is not maintainable.
Accordingly, CRM (A) 4328 of 2025 is dismissed. (Jay Sengupta, J.)
