This is an application wherein petitioner has prayed for a direction upon the Court below for expeditious disposal of Sessions Case No. 03 of 2021 corresponding to G.R. Case No. 1578 of 2014, presently pending before learned Additional Sessions Judge, Kalna, Burdwan.
Petitioner contended that the proceeding is pending for a long time. An investigation culminated into a charge-sheet and the prosecution has submitted the charge-sheet on 14th January, 2016. Thereafter, copy was supplied upon the accused persons in compliance with Section 207 of the Code of Criminal Procedure on 4.12.2018. Thereafter, the case was committed before the Sessions Court for trial but till date, the charge hearing has not been made. Petitioner accordingly prayed for a direction upon the court below for expeditious disposal of the abovementioned sessions case.
Having considered the submission made on behalf of the petitioner, I find that the prayer made herein is innocuous and if it is allowed in terms of the prayer made in the petition, it will not cause prejudice to the opposite parties.
In such view of the matter, C.R.R. 4804 of 2023 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the Sessions Case No. 03 of 2021 and to make his best effort to conclude the entire proceedings preferably within a period of six months from the date of communication of the order.
Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
