Petitioner(s) Mr. Kaushik Choudhury ... for the Petitioner(s) Mr. Abhisek Sinha Ms. Afreen Begum ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for one year four months and has been implicated on the basis of alleged recovery of 2966 ampoules of Buprenorphine injections. According to the learned advocate, the petitioner is a Toto driver who was allegedly implicated as the same was seized from the said vehicle.

Be that as it may, learned advocate for the State opposes the prayer for bail and submits that although two schedules were fixed but because of the circumstances beyond the control of the prosecution, trial of the case could not progress.

Having considered the quantum of seizure, I am not inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Rejected.

However, the learned trial court is directed to ensure that at least seizure list witnesses are examined within the next 90 days.

The petitioner would be at liberty to approach this court after the evidence of the seizure list witnesses are over.

Accordingly, CRM(NDPS) 1694 of 2025 is dismissed. Learned advocate for the State is directed to communicate this order through the learned Public Prosecutor conducting the trial for the learned Special Court to act on the aforesaid directions.
