Petitioner is aggrieved by the fact that in spite of informing the police authorities on or about 13.10.2023 in respect of the deposits accepted by Kalna Block-2 Co-Operative Agricultural Marketing Society Limited, they have not refunded the deposits after the same was matured. To that effect, after waiting for a considerable period of time such information was furnished with the Officer-in-charge, Kalna Police Station, but the concerned police station refused to take any action.
State has submitted a report. Report reflects that the police authorities have already registered Kalna Police Station Case No. 1408/2023 dated 18.12.2023 for investigation of the case and the
investigation of the case is in progress. Police authorities have already sent requisitions for obtaining documents.
In view of the petitioner being aggrieved and approaching this court at a stage when no case existed and the fact that investigation has commenced and is in progress, petitioner is granted liberty to file an appropriate application before the learned Judicial Magistrate in seisin of the matter for getting information regarding the progress of the investigation. Such application, if advised, should not be filed before 45 days from date.
The learned Magistrate will call for a report fixing 4 weeks and reflect in his order the outlines relating to the progress of the investigation. With the aforesaid observations WPA 28068 of 2023 is disposed of.
Report so submitted be kept with the record.
Copy of the report be handed over to the learned advocate for the petitioner.
