On being served only the State of West Bengal is being represented and the learned counsel for the State represents the respondent nos.1, 2 & 3. 3.

None appears for the respondent nos.4 & 5.

The present writ application has been preferred praying for i) Direction upon the respondent authorities to revoke the suspension order dated 21.10.2023.

ii) To give subsistence allowance with effect from the date of suspension i.e.

21.10.2023 and also further directing the Deputy Labour Commissioner, Haldia to dispose of the pending representation dated 03.10.2024 filed by the petitioner praying for

adjudicating the disputed referred before the said Commissioner/Conciliation Officer.

On hearing the learned counsel for the petitioner and considering the materials on record, the writ application is disposed of with the direction that the Deputy Labour Commissioner, Haldia shall dispose of the pending dispute referred before it, in accordance with law, preferably within a period of three months from the date of this order.

Pending disposal of the said dispute referred to the Deputy Labour Commissioner/Conciliation Officer, the representation for subsistence allowance is to be disposed of within 15 days from the date of this order, by passing necessary orders granting subsistence allowance as per rules, including all arrears due from the date of suspension i.e. 21.10.2023 and the said allowance shall be revised as per rules during the pendency of the dispute 7.

The writ petition stands disposed of.

Urgent Xerox certified copies of this order, if applied for, shall be supplied to the learned counsel for the parties as expeditiously as possible, in compliance of usual formalities. ( Shampa Dutt (Paul), J. )
