Kurban Sekh And ORS. v. State Of West Bengal
30.01.2026 Sl. No.30 NB CRM (A) 4331 of 2025 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachak PS Case No.1620/2025 dated 16.09.2025 under Section 126(2)/109/3(5) of the BNS and Section 25(1B)(a)/27/29 of the Arms Act.
And In the matter of: Kurban Sekh & Ors.
... petitioners Mr. Arup Kumar Bhowmick.
...for the petitioners.
Ms. Anasuya Sinha, Ms. Trisha Rakshit.
..for the State.
Learned counsel appearing on behalf of the petitioners submits that the petitioners have been falsely implicated in this case. Although there is an allegation of firing of a shot, no cartridge was seized. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. She relies on the statements of the victims as well as an independent eye-witness taking the names of the petitioners among others. The petitioners fled away from the spot while some others were intercepted. An improvised fire arm was seized from a co-accused.
Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
The application for anticipatory bail is, thus, rejected. The presence of the Investigating Officer is noted and is dispensed with.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
