Banerjee) Mr. Kushagra Shah ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the defendant no. 1 praying for a direction upon the learned Judge, 3rd Bench, City Civil Court at Calcutta to dispose of Title Suit No. 766 of 2021 expeditiously. Learned advocate appearing for the petitioner submits that the injunction application is yet to be disposed of. She further submits that an application under Section 151 of the Civil Procedure Code dated March 30, 2023 filed by the defendant no. 1/petitioner herein, is pending.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioner shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the

learned advocate representing them before the learned trial judge.

In the light of the submissions made by the learned advocate appearing for the petitioner, CO 4220 of 2024 stands disposed of by requesting the learned Judge, 3rd Bench, City Civil Court at Calcutta to take up the hearing of the application filed under Section 151 of the Civil Procedure Code dated March 30, 2023 on the next date fixed, i.e., on November 11, 2025, if the same is otherwise ready for hearing and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
