Petitioner contends that the victim lady committed suicide. Post mortem report indicates a case of ante mortem hanging. He prays for bail.

Learned Advocate for State opposes the bail prayer. 3.
We have considered the materials on record. Petitionerhusband and the victim were inside the hotel. Subsequently, body of the victim was recovered from the hotel room. Post mortem reveals indicates victim had died due to ante mortem hanging which is mostly suicidal. This improbilises the allegation of homicidal death. Petitioner is in custody for about 115 days and there is no chance of abscondence. 4.
Hence, we are inclined to grant bail to the petitioner. 5.
Accordingly, the petitioner viz., Sanjay Sarkar shall be released on bail upon furnishing a bond of Rs.10,000/- with
two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judicial Magistrate, Nabadwip, Nadia subject to condition that he shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event the petitioner fails to appear before the Trial Court without any justifiable cause, the trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
