Petitioner has prayed for quashing of Case No. AC 2258 of 2022 which is pending before the learned Judicial Magistrate, 6th Court, Alipore.

Having considered the issues so canvassed, I am of the opinion that no exceptional circumstances are there to invoke the jurisdiction under Section 482 Cr.P.C. Petitioners are granted liberty to first approach the learned Sessions Judge under Section 29 of the Protection of Women from Domestic Violence Act, 2005.

With the aforesaid observations, the present revisional applications being CRR 4811 of 2023 is disposed of. Pending applications, if any, are disposed of. Department is directed to allow the learned advocate for the petitioner to take back the certified copy after the same is replaced by the photostat copy.
