Hossain ....for the State Petitioner complains that he purchased a property by investing his money in the name of his wife and subsequently the petitioner and his mother (who is paralysed) has been thrown out from the said property.

Reports submitted by the State reflects that a case has been initiated on the complaint of the private respondent being Haridevpur P.S. Case No. 388/24 while on the other hand on the complaint of the present petitioner another case being Haridevpur P.S. Case No. 747/24 has been registered for investigation.

Since there is a marital discord which is palpable on the face of the report, I direct that the petitioner would approach the jurisdictional

criminal/civil court for adjudicating on the issues particularly with regard to the right of his residence. Report so submitted be kept with the record.

With the aforesaid observations, the writ petition being WPA 29390 of 2024 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
