Petitioner has been implicated in connection with the proceeding under Section 138 of N.I. Act being Complaint Case No. 431 of 2017.

Mr. Chatterjee, learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges but she has been implicated in connection with the instant case. According to the learned advocate that the petitioner has been facing ordeal of trial for the last six years. Be that as it may, so far as the issue relating to legally enforceable debt or liability is concerned, the same would be decided in course of the trial.

Learned Magistrate is directed that in case an application under Section 205 Cr.P.C. is filed for dispensing with the day to day appearance in course of the trial and an undertaking is given by the petitioner as has been settled by the Hon'ble Supreme Court, the learned trial court would consider the said application if the learned lawyer regularly

appears and the petitioner undertakes that she would appear before the Court as and when called for.

Having considered that the proceedings are pending for the last six years, I direct that the learned Magistrate would fix one date in every two month so that the trial of the case can be concluded within a reasonable period of time without any unnecessary delay.

With the aforesaid observations, the present revisional applications being CRR 4815 of 2023 is disposed of. Pending applications, if any, are disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
