(A) 5596 of 2023 06.02.2024 ML-519 Court No.29 (AD) (Rejected) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Balurghat Police Station Case No.340 of 2023 dated 29.04.2023 under Sections 21(C)/22(C)/23(C)/27A/28/29 of the NDPS Act.(NDPS Case No.38 of 2023).

And In the matter of: Bapi Barman ....petitioner.

Mr. Amanul Islam Mr. Sourav Mukherjee ... for the petitioner.

Mr. Angshuman Chakraborty ... for the State.

Two independent persons implicate the petitioner in the business of narcotics.

Police filed charge sheet.

Notwithstanding filing the charge sheet, given the materials in the case diary, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985. Consequently, we are unable to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner is rejected.

C.R.M. (A) 5596 of 2023 is dismissed.
