The grievance of the petitioners is directed against non disposal of an appeal filed under Section 19(1) of the Right to Information Act (Act of 2005).

It is submitted on behalf of the petitioners that despite an order dated September 5, 2015 passed by a Coordinate Bench, an appeal filed under the Act of 2005 has not yet been disposed of.

It is submitted on behalf of the respondents that a communication dated August 2, 2016 has been furnished to the petitioner containing the necessary information. It is also submitted that the appeal which has been filed by the petitioner is not in proper form and is not maintainable.

Be that as it may, without prejudice to the rights and contentions of the parties, the respondent authorities are directed to disposed of

the appeal filed under Section 19(1) of the Act of 2005 pending with the respondent authorities, within a period of eight weeks from the date of communication of this order.

It is made clear that this Court has not gone into the merits of the case and the respondent authorities shall act in accordance with law both on the maintainability and the merits of the subject appeal without being influenced by any observations in this order.

With the above directions, WPA 28999 of 2016 stands disposed of.

There shall, however, be no order as to costs.
