Learned Advocate representing the applicant submits that the order passed by the co-ordinate Bench on the connected writ petition dated 4th May, 2023, was appealed against by presenting an intra-court appeal being MAT 1385 of 2023. According to the applicant, the said appeal was disposed of by the Hon'ble Division Bench vide judgment and order dated 28th February, 2024, modifying the order passed by the co-ordinate Bench on 4th May, 2023.

In view of such submission made on behalf of the applicant and the order passed by the Hon'ble Division Bench on 28th February, 2024, it appears that the judgment and order dated 4th May, 2023, passed by the co-ordinate Bench merges with the order passed by the Hon'ble Division Bench dated 28th February, 2024. Accordingly, the contempt application stands disposed of and contempt proceeding stands dropped. Urgent photostat certified copy of this order, if applied for, be made available to the learned Advocates for the parties on the usual undertakings.
