On the file being sent by the department, this matter was placed in the list. It is running in the list for several weeks and has been called on from time to time.
No one has ever responded when the matter has been called on. The matter, therefor, was placed in the list with the note "First Chance". No one responded even at this stage. Then the matter appeared in the list marked as "Last Chance". Despite being called on several times when the matter appeared in the list marked as "Last Chance", no one appeared.
The petitioner had challenged an order directing recovery of Rs.2,55,98,039/- by the Employees Provident Fund Organisation (EPFO) from the petitioner-company.
The writ petition was filed in the year 2016 and the same has not been prosecuted since then.
It appears that with the passage of time the writ petition has become infructuous and as such, the
petitioner is no more interested to proceed with the same. The same is accordingly disposed of without any order.
