This application is filed seeking special leave to appeal under Section 378(4) of the Code of Criminal Procedure, 1973 against the judgment and order of acquittal dated 5th October, 2023 passed by the learned Metropolitan Magistrate, 4th Court at Calcutta in connection with Complaint Case No.23151 of 2012 under Sections 138/141 of the Negotiable Instruments Act, 1881. 3.

Having heard the learned advocate on the ground of appeal and also having gone through the judgment impugned, I allow the instant application for special leave to appeal.

The appellant is at liberty to prefer an appeal within the statutory period.

With the aforesaid observation, CRMSPL 82 of 2023 stands disposed of.
