Though it was submitted on behalf of the State on the earlier occasion that another organisation has already applied before the police authority for organising the same programme in the same venue at the same time as the petitioner intends to, it appears that after the earlier order was passed on 22nd December, 2025, the police authority has invited an application for organising such programme from the other organisation. This is extremely unfortunate and is not expected from an authority as neutral as the police. However, the petitioner intends to organise a 'Harinam Sankirtan' at Bapujinagar High School Ground and has obtained requisite permission from the teacher in charge of the school as well as fire service and electricity department. The organisation is allowed to hold such programme from 25th December, 2025 to 31st December, 2025 subject to the following conditions.

1. The number of participants should not exceed 500 at any given point of time.

2. Sound system shall be used within the permissible limit as prescribed by the Hon'ble High Court and the West Bengal Pollution Control Board.

3. The names of five volunteers along with their mobile phone numbers be furnished before the police authority. The volunteers and organisers shall be responsible for any violation.

4. The participants shall not spill over to the adjoining road and shall not obstruct traffic/vehicular movement.

5. The participants shall abide by the instructions of the on duty officers and shall act in a manner so as to ensure that no inconvenience is caused to the neighbours or to the public at large.

6. The participants shall disperse within one hour of conclusion of the programme.

7. The high school ground shall be restored to its original position within hours of the programme.

With the aforesaid observations and directions, the writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
