The petitioners are aggrieved by the fact that he purchased the property and thereafter is being resisted from entering the said property by the private respondents.

Petitioners to that effect have instituted a proceeding under Section 163 of the BNSS as well as informed the police authorities regarding the right over the said property.

Mr. Amitesh Banerjee, learned Senior Standing Counsel appearing on behalf of the State has submitted a report. The report reflects that some persons are in possession of the property and the petitioners are resisted from entering in the said property.

This Court will not enter into the domain of the Civil Court for passing directions in the nature of evicting any person whether they are in legal or illegal possession. Petitioners are granted liberty to approach the jurisdictional Civil Court for appropriate reliefs. With the above observations, WPA 29461 of 2024 is disposed of.

There shall be no order as to costs.

Report so submitted be kept with the records.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this court.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
