06.3.2026 SL No. 4 Ct No. 22 SB CRR 4820 of 2023 Dipti Chowdhury nee Sasmal Vs.

State of West Bengal & Anr.

Mr. Prithu Ghosh Mr. Debottam Das ... for the respondent no. 2

1. The matter is appearing today under the heading "To Be Mentioned" at the instance of the Learned Advocate for the Opposite Party No. 2 / husband for correction in the CRAN 1 of 2024.

2. Learned Counsel appearing for the private opposite parties seeks leave to rectify a clerical omission in the application being CRAN 1 of 2024. It is submitted that while the judgment dated 08th March 2024, passed in C.R.R 4820 of 2023 by a Co-ordinate Bench, was duly annexed to the application, the physical marking of the same as "Annexure P-3" was inadvertently omitted from the top of the document itself.

3. Learned Counsel further draws the attention of this Court to paragraph 7, page 4 of the said application, wherein the document has been explicitly referred to and incorporated as "Annexure P-3." It is stated that the Department is unable to process the application for a certified copy of the order owing to this technical discrepancy between the pleadings and the annexed documents. To subserve the ends of justice and

ensure procedural regularity, leave is sought to mark the document accordingly.

4. I have perused the records and heard the submissions.

5. The omission appears to be an inadvertent error on the face of the record, purely formal in nature, and does not touch upon the merits of the case. Given that the document is already substantively identified within the body of the verified petition, allowing the prayer for marking would merely bring the physical record into conformity with the pleadings. No prejudice shall be caused to any of the parties by such a correction;

rather, it is necessary to facilitate the administrative functions of the Department.

6. In view of the above, liberty is granted to the Learned Advocate-on-Record for the private opposite parties to write "Annexure P-3" at the top of the copy of the judgment dated 08th March 2024 annexed to CRAN 1 of 2024. Such correction shall be carried out in the presence of an officer of the Department.

7. The Department is directed to treat the defect as cured upon such marking and to proceed with the issuance of the certified copy in accordance with the law.
