Report reflects that the next date has been fixed on 3rd February, 2024 and 5th February, 2024 for evidence. Learned advocate appearing for the petitioner submits that the case being Airport Police Station Case No.204 of 2016 was initiated on 06.08.2016 and subsequently charge-sheet was submitted. The trial commenced in the year 2017. However, till date, out of seven witnesses, only the mother of the victim girl has been examined and rest of the six witnesses are yet to be examined. Having regard to the slow progress of the case, I am of the view that the learned trial court would fix a schedule consisting of three dates and fix such schedule on and from the month of March, 2024 to each and every month so that the trial of the case can be taken to its logical conclusion within a reasonable period of
time. In case any witness is not available, the learned trial court will communicate with the Deputy Commissioner-in-Charge of Airport Police Station so that the availability of the witness is ensured and report is submitted before the court regarding the non-availability of the witnesses' concerned. Having regard to the period which has already been lapsed in the meantime, all efforts be taken by stakeholders to conclude the trial at the earliest. With the aforesaid observations, CRR 4823 of 2023 is disposed of.
Pending connected application, if any, is consequently disposed of.
