1. The only grievance of the petitioner in the present writ application is that the petitioner has made a representation to the Hon'ble Chief Election Commissioner, Election Commission of India as well as Chief Electoral Officer, West Bengal State Election Commission, requesting to take up the matter at the earliest with all due seriousness and issue suitable guidelines/circular/corrigendum as it deem fit, within 48 hours from the date of receiving the communication, directing the officers/agents/men not to accept such invalid OBC certificates in the State of West Bengal as document to claim of entry in the upcoming revised electoral roll.

2. Learned Counsel for petitioner submits that though the application has been made on 4th December, 2025 but till date, no decision has been taken by the respondent authorities. Accordingly, the petitioner has filed this writ application.

3. The learned Counsel appearing for the Election Commission of India, submits that the matter is pending before the Hon'ble Supreme Court with regard to validity of the Special Intensive Revision (SIR) of electoral rolls and as such, no order can be passed in the present writ application.

4. Heard both the learned Counsel for the respective parties. The petitioner has not challenged any procedure of the SIR but the only grievance of the petitioner is that, the ECI has not considered the prayer as made in the representation. This Court is of the view that no purpose would be served by keeping the writ petition pending.

Accordingly, the present writ petition is disposed of by directing the Chief Electoral Officer, West Bengal State Election Commission being respondent no.5 to this writ application, to consider the representation submitted by the petitioner on 4th December, 2025 and to pass a reasoned speaking order and to communicate the same to the petitioner within a week from the date of receipt of this order.

6. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
