Report has been submitted by the Assistant Registrar (Criminal Section) disclosing that administrative notices were issued to the petitioner and opposite party no. 2 through the learned Chief Judicial Magistrate, 24 parganas (North) and learned Chief Metropolitan Magistrate, Calcutta but no service return has been received from the learned Chief Judicial Magistrate.
It is further stated that the notice to opposite party no.2 has been returned unserved. The report is taken on record. Mr. Mondal, Learned advocate for the petitioner submits that the petitioner does not want to proceed with the present application as police has submitted Final Report in this case. The written instruction of the petitioner to his advocate that he does not want to continue with the petitioner for quashing of the proceedings has been filed. Le the same be taken on record. Learned advocate for the State produced a report submitted by Sub-Inspector Pritam Pramanik, Phoolbagan Police
Station disclosing that report has been submitted in final form in this case bearing No. 01 dated 9.1.2015 and the same has been accepted by learned Additional Chief Judicial Magistrate, Sealdah on 13.5.2016.
Considered the submissions made as well as the report received from police and the communication of the petitioner to his advocate.
The application, praying for hearing of G.R. case no. 3156 of 2014 pending before learned Additional Chief Judicial Magistrate, Sealdah in connection with Phoolbagan Police station case no. 229 of 2014 dated 15.9.2014 under Sections 325/114 of the Indian Penal Code and Section 3(1)(x) of the Scheduled Caste & Scheduled Tribes (Prevention of Atrocities) Act, 1989 has become infructuous.
The revisional application is therefore dismissed. Interim order, if any, stands vacated.
