The petitioner claims to be lawfully wedded second wife of late Biplab Kumar Das. The first wife is stated to have died on 30th September, 2012. The only evidence of marriage produced by the petitioner is a notarised affidavit executed in Bilaspur dated 5th June, 2023. There is no other evidence or document showing the marriage of the petitioner with the deceased Biplab Kumar Das.

Counsel for the Port Trust submits that the deceased employee had only indicated Jayanti Das, late wife, Vijayananda Das, son and Shaswati Das, daughter as his family members in the declaration dated 02.08.2004.

The Port Trust has also received another application from one Sanchita Das claiming to the legal married wife of late Biplab Kumar Das.

In those circumstances, no relief can be granted to the petitioner.

Accordingly, the writ petition is dismissed.

6.

The documents produced by the Port Trust are returned to the advocate.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
