Petitioner although has taken up many issues in the writ petition in respect of the property complained of, however has restricted his prayer before this court after relying on an earlier report submitted before an Executive Magistrate in respect of a proceedings under section 126 BNSS being drawn up for maintaining peace and tranquility. Learned advocate for the private respondents submits that the land which has been referred to has already been acquired by the Government. As such the private respondents have no role to play for creating any disturbance or encroaching upon the said property as complained of by the petitioner.

Mr. Ahmed, learned advocate appearing for the State is present.

Having considered the submissions and the fact that there is a dispute and difference between the petitioner and private respondents, I direct that the police authorities would keep surveillance and ensure that no breach of the peace and/or tranquility takes place and/or any untoward incident results because of the inimical relationship existing between the parties. With the aforesaid observations WPA 29514 of 2024 is disposed of.
