The petitioner is aggrieved by the nature and activity carried out by the private respondent nos.6 to 12 in respect of the possession of his property. The petitioner to that effect has already informed the police authorities in December 2023. But till date no action has been taken.

Learned advocate for the State submits report. The report reflects that the police authorities have taken action by way of drawing up proceedings under Sections 107/116 of the Cr.P.C.

Be that as it may, since the petitioner complains that till date he is faced with disturbance at the behest of private respondents, liberty is granted to the petitioner to file a fresh complaint before the police authorities, particularly, the Officer-in-Charge, Burwan Police Station, Murshidabad Police District, who on receipt of the same would try to assess whether any cognizable offence has been made out

and act in accordance with law. In the meantime, the police authorities would keep a strict vigil and ensure no breach of peace takes place or any untoward incident results because of the existing inimical relationship between the petitioner and the private respondents.

With the aforesaid observation, WPA 29475 of 2024 is disposed of.

The report submitted be kept with the record. Copy of the report be handed over to the learned advocate for the petitioner.

All the parties shall act on the basis of the server copy of the order.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
